This editorial update clarifies the signup action in the current app. It does not change your rights or data permissions and does not require a new agreement. Version 1.0, effective August 23, 2026, remains the agreement recorded in the Service's consent history.

1. Agreement and who operates Potty Watch

These Terms of Service ("Terms") are an agreement between you and the developer identified as the Seller on Potty Watch Tracker's App Store product page ("Potty Watch," "we," "us," or "our"). They govern the online services, household synchronization, reports, and other features provided through the Potty Watch Tracker app (together, the "Service").

You must be at least 18 years old and legally able to agree to these Terms. Potty Watch is for adult caregivers. It does not create accounts for children, and children must not use the Service or submit information directly.

By tapping Allow & Continue beside the signup notice, you agree to the Terms of Service and allow the bathroom-record uses described in that notice. This action replaces the checkboxes used in earlier app versions. Permission for bathroom records can be withdrawn in Privacy & Account without withdrawing your agreement to these Terms. Our Privacy Policy and Washington Consumer Health Data Privacy Policy describe data practices; they do not replace these Terms. Creating a caregiver group enables shared access for its creator; an invited caregiver must enter the group's six-digit code and confirm Join before receiving access.

2. What the Service does

Potty Watch is an organizational tool for adult caregivers who are already using a physical potty-watch routine. It lets a caregiver enter bathroom visits and accidents, record prompt context and physical-watch intervals, review counts and history, export records, and, if enabled, synchronize one household's records among authorized caregiver devices.

Any pattern, checkpoint, or interval text is generated only from records entered in Potty Watch. It may be incomplete, delayed, or wrong if entries are missing, inaccurate, or not representative. You decide whether and how to change a physical-watch setting.

3. General information only; no medical service

Potty Watch is a general-wellness recordkeeping and organization tool. It does not provide medical advice, diagnosis, treatment, prevention, screening, clinical monitoring, or emergency services. It does not measure the child's body or determine whether a child is medically or developmentally ready for any step. No clinician reviews your entries or the app's output.

Do not use Potty Watch as a substitute for professional judgment or care. Talk with a qualified health-care professional about any health concern and before making a medical decision. If you believe a child needs urgent medical attention, contact emergency services or an appropriate health-care professional.

4. Your authority and responsibilities

You represent that you are the child's parent or legal guardian, or that a parent or legal guardian has authorized you to enter and use the child's records for the household. You must enter accurate information to the best of your knowledge, protect your device and access credentials, and use the Service only for lawful household purposes.

You may not:

• let a child create or operate an account;
• access or disclose another household's records without authorization;
• invite a person who is not a trusted caregiver authorized to see the child's records;
• use the Service to harass, surveil, discriminate against, or harm another person;
• probe, disrupt, overload, bypass, or defeat the Service's security or access controls;
• introduce malware or use automated means to scrape or extract the Service; or
• copy, modify, distribute, sell, lease, or reverse engineer the app except to the extent applicable law does not permit that restriction.

5. Accounts and caregiver groups

The Service uses an app account and installation identifier to keep records separated and to synchronize authorized devices. Keep your device passcode and any invitation code private.

A caregiver group can include up to five active caregiver devices. Creating or joining a group makes existing and future household records available to authorized caregivers in that group. Current Potty Watch versions use one-time invitation codes that expire after 30 minutes or one successful join. During a limited compatibility period, an older supported app version may still accept a legacy six-character family code that is not one-time. Keep either kind of code private, update all caregiver devices when prompted, and do not treat a family code as a permanent password. Each caregiver must accept their own Terms and data notices. The person who invites another caregiver is responsible for confirming that the invitee is authorized to see the child's records.

Leaving a caregiver group removes that caregiver device's access and clears its local family cache. If another active caregiver keeps the group, records entered by its caregivers remain with the group. If no active caregiver remains, the group and all of its saved records are deleted. Removing a caregiver should stop that caregiver's future access, but you should not share exports or screenshots with anyone you do not trust.

6. Your records and exports

As between you and Potty Watch, you retain your rights in information you enter. You give us a limited permission to host, process, transmit, reproduce, and format that information only as needed to operate, secure, support, and legally administer the Service. This permission ends when the information is deleted, except to the limited extent a temporary copy must remain in a backup or we are legally required to preserve particular information.

Exports may contain sensitive information. You are responsible for the people and apps with which you choose to share an export after it leaves Potty Watch. A PDF summary omits free-text notes; raw CSV and JSON exports may include them.

7. Subscription and Apple billing

Paid access is offered as an auto-renewable subscription through Apple's in-app purchase system. Before purchase, the app displays the subscription name, service included, billing period, localized price, and any trial for which StoreKit reports that you are eligible. If a trial is offered, the app displays its duration and the price and period that begin after the trial.

Payment is charged by Apple to your Apple Account. The subscription renews automatically for the displayed period unless you cancel through Apple before renewal. Apple controls billing, taxes, refunds, price-change consent, cancellation, and restoration of App Store purchases under Apple's terms. You can manage or cancel through Apple's subscription settings. Potty Watch Settings provides Restore Purchases to ask StoreKit to restore an eligible purchase.

Deleting your Potty Watch account, leaving a caregiver group, removing the app, or withdrawing health-data consent does not cancel an App Store subscription. Cancel the subscription separately through Apple.

If paid access ends, the Service may become read-, export-, and delete-only. We will not intentionally prevent you from accessing privacy controls or deleting your account because a subscription has ended.

8. Availability, changes, and termination

The Service depends on devices, internet connections, Apple, and infrastructure outside our complete control. We may maintain, change, suspend, or discontinue features. We will not materially expand consumer-health-data categories, purposes, or household disclosure without the notice and consent required by applicable law.

You may stop using the Service at any time. You may leave a caregiver group or delete your caregiver account in Settings. We may suspend or terminate access when reasonably necessary to protect a child, a user, the Service, or another household; investigate fraud or abuse; comply with law; or address a serious violation of these Terms. Where reasonable, we will provide notice and a way to export or delete records.

Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, dispute terms, and legally required records—will survive.

9. App license and intellectual property

Potty Watch and its licensors own the app, software, design, branding, and documentation, excluding records you enter. Your license to install and use the app is governed by Apple's standard Licensed Application End User License Agreement unless a different license is shown by Apple at download. These Terms govern the separate Potty Watch Service.

Feedback is voluntary. If you send feedback, you allow us to use it without payment or obligation, but we will not intentionally use a child's identifiable bathroom record as product feedback.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We do not promise that it will be uninterrupted, error-free, complete, secure against every threat, or suitable for a particular child or purpose. We do not promise that synced records will be current, that a report will include every event, or that any suggested checkpoint or setting change will produce a result.

Some jurisdictions do not allow certain warranty disclaimers. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, Potty Watch will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, or loss of goodwill arising from the Service. To the maximum extent permitted by law, Potty Watch's total liability for claims arising from the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or 100 U.S. dollars.

These limits do not apply where prohibited by law, and they do not limit liability for fraud, willful misconduct, or any other liability that cannot lawfully be limited. Your jurisdiction may give you additional rights.

12. Changes to these Terms

We may update these Terms. We will show the new version and effective date. We will request a new affirmative agreement before a material change applies to continued use. Editorial corrections and changes that do not reduce your rights may be communicated without requiring a new agreement. The version you accepted remains recorded in the Service's consent history.

13. Governing law

Except where your local consumer law requires otherwise, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Nothing in this section deprives you of mandatory rights or a forum available under applicable consumer law.

14. General terms

If a court finds part of these Terms unenforceable, the remaining terms remain in effect to the extent permitted by law. A delay in enforcing a term is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer these Terms as part of a lawful reorganization, merger, financing, sale, or transfer of the Service, subject to applicable privacy law. These Terms, the Apple license that applies to the app, and any separate terms presented for a specific feature form the agreement governing your use of the Service.
