1. Acceptance of Terms

By downloading, installing, or using the Potty Watch Tracker application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Potty Watch Tracker ("Company", "we", "us", or "our") regarding your use of the App.

2. Description of Service

Potty Watch Tracker is a mobile application designed to help parents and caregivers track their children's potty training progress. The App allows you to:

  • Log bathroom events (successes and accidents)
  • Track progress with analytics and reports
  • Share data with family members and caregivers
  • Generate medical reports for healthcare providers
  • Receive notifications about logged events

The App is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years old to use this App. The App is designed for parents and caregivers to track children's potty training progress. By using the App, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal authority to track the child's information
  • You are the parent, legal guardian, or authorized caregiver of the child
  • You will not allow children to directly use the App

4. Account Registration and Security

4.1 Device-Based Authentication

The App uses device-based authentication. No password is required. Your account is tied to your device's unique identifier.

4.2 Account Responsibilities

You are responsible for:

  • Maintaining the security of your device
  • All activities that occur under your account
  • Ensuring the accuracy of information you provide
  • Notifying us immediately of any unauthorized use

4.3 Family Sharing

Family sharing is a premium feature. You may invite other family members or caregivers to track the same child. By inviting others, you:

  • Confirm they have permission to access the child's data
  • Understand they will have full access to all logged events

5. License to Use

5.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

5.2 License Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Sell, rent, lease, or sublicense the App
  • Use the App for any illegal or unauthorized purpose
  • Remove or alter any proprietary notices

6. User Content

6.1 Your Content

You retain ownership of all content you submit to the App ("User Content"), including but not limited to:

  • Event logs and notes
  • Child and caregiver names

6.2 License to Your Content

By submitting User Content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the App's services to you.

6.3 Content Guidelines

You agree that your User Content will not:

  • Violate any laws or regulations
  • Infringe on any third-party rights
  • Contain inappropriate or offensive material
  • Include personal information of others without consent

7. Prohibited Uses

You may not use the App to:

  • Violate any applicable laws or regulations
  • Track information about children without proper authorization
  • Share or distribute other users' data without permission
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Use automated systems or bots to access the App
  • Collect or harvest user data
  • Transmit viruses or malicious code

8. Privacy

9. Purchases and Subscriptions

9.1 In-App Purchases

The App may offer optional premium features through in-app purchases. All purchases are:

  • Processed through Apple's App Store
  • Subject to Apple's terms and conditions
  • Non-refundable except as required by law

9.2 Subscription Terms

If you purchase a subscription:

  • Payment will be charged to your Apple ID account
  • Subscriptions automatically renew unless canceled
  • You can manage subscriptions in your App Store account settings
  • Cancellation must occur at least 24 hours before renewal

9.3 Free Features

Core tracking features remain free. Family sharing is a premium feature. We reserve the right to modify which features are free or premium at any time.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION

We do not guarantee that the App will be uninterrupted, secure, or error-free. Use of the App is at your own risk.

11. Medical Disclaimer

The App is not intended to provide medical advice. Information tracked in the App should not replace professional medical consultation. Always consult with qualified healthcare providers regarding your child's health and development.

The medical reports generated by the App are intended solely as informational tools for healthcare providers and should not be used for self-diagnosis or treatment.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • SERVICE INTERRUPTIONS OR DELAYS
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Potty Watch Tracker and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account through the App settings
  • Uninstalling the App from your device

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if:

  • You breach these Terms
  • We are required to do so by law
  • We discontinue the App

14.3 Effect of Termination

Upon termination:

  • Your right to use the App ceases immediately
  • Your data will be deleted per our Privacy Policy
  • Provisions that should survive will remain in effect

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the modified Terms.

For material changes, we will provide notice through the App or via email if you've provided one.

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

16.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

17. General Provisions

17.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the App.

17.2 Severability

If any provision of these Terms is found invalid, the remaining provisions will continue in effect.

17.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

18. Apple-Specific Terms

If you access the App through an Apple device:

  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product warranties
  • Apple is not responsible for addressing claims relating to the App
  • Apple is not responsible for third-party intellectual property claims
  • Apple and its subsidiaries are third-party beneficiaries of these Terms
